E-signature legality in Australia
Electronic signatures are recognised federally and through mirror state Acts, under a technology-neutral reliability test with no accreditation or certificate requirement.
The cleanest yes of any country here. Nothing requires an identity check or a licensed certificate, and the statute expressly allows the audit trail itself to establish reliability. The only things to watch are getting counterparty consent and staying away from Commonwealth statutory declarations.
The governing law
Electronic Transactions Act 1999 (Cth); Electronic Transactions Regulations 2020 (Cth); Corporations Act 2001 (Cth), as amended by the Corporations Amendment (Meetings and Documents) Act 2022; Statutory Declarations Act 1959 (Cth), as amended in 2023.
Types of signature recognised
No tiers at all. There is a single functional test: the method must identify the signer, show their intent, and be appropriately reliable. Simple, advanced and qualified language in vendor material is imported European vocabulary with no basis in Australian law.

What you cannot sign electronically in Australia
This is the part worth reading twice. These documents either cannot be signed electronically at all, or need a higher-assurance form than an ordinary online signature.
- Commonwealth statutory declarations, which need their own witnessing or approved digital verification pathway
- Bills of exchange and cheques
- Shipping registration documents
- Commonwealth electoral and referendum documents
- Commonwealth inscribed stock
- Court and tribunal practice and procedure documents
What matters in practice
Method plus intention decides it, and reliability can be proven after the fact, so a strong audit trail can cure a weak method retrospectively. Recipient consent is needed outside government dealings and can be inferred from conduct.
